Terms of Service

All payments to CodedChaos Hosting are nonrefundable.

By signing up for CodedChaos Hosting ("Host" "Admin" "CC" "We") Hosting, you ("client" "customer" "you") agree to abide by the following Terms of Service, no excuses.

Simple summary
Be good, have fun, help yourself, and don't hurt anybody.
Now for the people that can't follow that, here are the terms spelled out in black and white.

1.) Account Creation
1. Only one hosting account per person without explicit approval from a CC Admin.
2. All registration information must be 100% accurate, we will NEVER sell/give/trade client information to anyone. With the exception of authorities that have sufficient warrant to request your information.
3. You may not just use our hosting to store your stuff, we host websites, not online file archives.
4. Inactive accounts will be deleted, what is defined as inactivity is solely up to the server admins.
5. Only one person may use an account without explicit approval from a CC Admin.

2.) Content
1. YOU are responsible for YOU.
2. No porn.
3. No copyrighted material that you do not have permission to distribute, post, host, whatever you're doing with it.
4. I shouldn't have to say this (since it's technically the same as part 3.) but NO warez or cracks.
5. No viruses, spyware, malware, etc.

3.) Backups and Data Loss.
Your use of the service is at your sole risk. CC is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on your account. There is no warranty expressed or implied for any of our services.

4.) Resource Usage
Prohibited actions include, but are not solely limited to:
1) Use 25% or more of system resources for longer then 30 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
3) Run any software that interfaces with an IRC (Internet Relay Chat) network.
4)Run any bit torrent client (such as TorrentFlux) that downloads files from others, Trackers are OK as long as the content is legal.
5) Run any gaming servers such as counter-strike, half-life, battlefield1492, teamspeak, ventrilo.

5.) Indemnification
Customer agrees that it shall defend, indemnify, save and hold CC blameless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against CC, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold blameless CC against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with CC; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;(3) copyright infringement and (4) any defective products sold to customers from CC' server(s).

6.) SPAM and Unsolicited Commercial Email (UCE)
NO SPAM. If we see signs that your are spamming (or we are notified of it) your account will be terminated immediately.

7.) Network
1) Bandwidth Usage. CC will monitor Customer's bandwidth. CC shall have the right to take corrective action if Customer's usage negatively impacts other clients.

2) Open Proxies and relays:If CC discovers an open proxy or relay that someone on the Internet might be able to use to without a password or other security the site it is on will be subject to immediate suspension or in some extreme cases, termination.

3) System and Network Security: Users are prohibited from violating or attempting to violate the security of the CC Network. Violations of system or network security may result in civil or criminal liability. CC will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, but are not limited to:

1. Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.

2. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization. C) Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing."

4) Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

5) Taking any action in order to obtain services to which such User is not entitled.

8.) Support Boundaries
The CC staff offers support via e-mail, DirectAdmin ticket system, IRC, and AIM. Please note that we do not answer questions related to HTML, PHP, MySQL, CGI, etc unless something isn't functioning that we can control.

9.) DMCA Policy
CodedChaos Hosting is in compliance with 17 U.S.C. � 512 and the Digital Millennium Copyright Act (DMCA). We respond to any infringement notices and take appropriate actions under the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. 10.) Failure to read
Ignorance is bliss, but also grounds to be terminated. Know what you agree to, and follow it.

11.) Changes to the TOS
CodedChaos Hosting reserves the right to revise its Terms of Service at any time without notice. It is YOUR responsibility to check the Terms of Service for any updates and to maintain your compliance with the Terms of Service.
